EN CLIQUANT SUR LE BOUTON \u00ab J\u2019ACCEPTE \u00bb, OU EN INSTALLANT OU EN UTILISANT LES LOGICIELS Eco-Sai et Eco-Sai Revit PlugIn, VOUS CONSENTEZ A ETRE LIE PAR LE CONTRAT. SI VOUS N\u2019ACCEPTEZ PAS LES MODALITES ET CONDITIONS DU PRESENT CONTRAT, NE CLIQUEZ PAS SUR LE BOUTON \u00ab J\u2019ACCEPTE \u00bb ET N\u2019INSTALLEZ NI N\u2019UTILISEZ AUCUNE PARTIE DES LOGICIELS Eco-Sai et Eco-Sai Revit PlugIn. AU COURS DU PROCESSUS D\u2019INSTALLATION DE Eco-Sai et Eco-Sai Revit PlugIn ET ULTERIEUREMENT, LA POSSIBILITE D\u2019INSTALLER DES COMPOSANTS SUPPLEMENTAIRES PROVENANT DE FOURNISSEURS DE LOGICIELS TIERS PEUT VOUS ETRE OFFERTE. L\u2019INSTALLATION ET L\u2019UTILISATION DE CES COMPOSANTS TIERS PEUVENT ETRE REGIES PAR DES CONTRATS DE LICENCE SUPPLEMENTAIRES.<\/p>\n<p>1. OCTROI DE LICENCE. E4tech Software SA vous octroie une licence non exclusive vous autorisant \u00e0 utiliser la version en code ex\u00e9cutable des logiciels. Ce contrat r\u00e9git \u00e9galement toute mise \u00e0 jour fournie par E4tech Software SA, qui remplacerait et\/ou compl\u00e9terait les logiciels originaux, sauf si une telle mise \u00e0 jour devait s\u2019accompagner d\u2019une licence distincte, auquel cas les modalit\u00e9s de cette licence pr\u00e9vaudraient. Eco-Sai et USai Revit PlugIn sont livr\u00e9s nominalement, sur la base d&#8217;une licence simple ou multiple par acqu\u00e9reur (selon la licence achet\u00e9e). Celui-ci a donc le droit d&#8217;installer le logiciel sur les ordinateurs de son entreprise, de son bureau, de l&#8217;\u00e9cole, etc. Pour cela, il utilise la clef informatique qui lui est livr\u00e9e apr\u00e8s payement du logiciel.<\/p>\n<p>2. RESILIATION. En cas de non-respect des dispositions du pr\u00e9sent contrat, votre droit d\u2019utilisation du logiciel sera r\u00e9sili\u00e9 imm\u00e9diatement et sans pr\u00e9avis, mais toutes les dispositions du contrat, \u00e0 l\u2019exception de l\u2019octroi de licence (paragraphe 1), resteront en vigueur m\u00eame apr\u00e8s cette r\u00e9siliation. En cas de r\u00e9siliation, vous devez d\u00e9truire toutes les copies du logiciel.<\/p>\n<p>3. DROITS DE PROPRIETE. E4tech Software SA, en son propre nom et au nom de ses donneurs de licence, se r\u00e9serve par la pr\u00e9sente tous les droits de propri\u00e9t\u00e9 intellectuelle concernant les logiciels, \u00e0 l\u2019exception des droits express\u00e9ment octroy\u00e9s dans le pr\u00e9sent contrat. Vous ne devez ni enlever ni modifier quelque marque de commerce, logo, copyright ou autre avis relatif au droit de propri\u00e9t\u00e9 que ce soit, pr\u00e9sent dans ou sur le logiciel. Cette licence ne vous donne aucun droit d\u2019utiliser les marques de commerce, marques de service ou logos de E4tech Software SA ou de ses donneurs de licence.<\/p>\n<p>4. EXONERATION DE GARANTIE. LES LOGICIELS SONT FOURNIS \u00ab EN L\u2019ETAT \u00bb ET AVEC TOUS LEURS DEFAUTS. DANS LA MESURE PERMISE PAR LA LOI, E4TECH SOFTWARE SA ET LES DISTRIBUTEURS ET DONNEURS DE LICENCE DE E4TECH SOFTWARE SA DECLARENT PAR LA PRESENTE N\u2019OFFRIR AUCUNE GARANTIE, EXPRESSE OU TACITE, Y COMPRIS MAIS SANS S\u2019Y LIMITER, LES GARANTIES ASSURANT QUE LES LOGICIELS SONT EXEMPTS DE DEFAUTS, COMMERCIALISABLES, ADAPTES A UN USAGE PARTICULIER ET CONFORMES AUX REGLES DE PROPRIETE INTELLECTUELLE. VOUS ASSUMEZ L\u2019ENTIERE RESPONSABILITE DES RISQUES ENCOURUS EN CHOISISSANT LES LOGICIELS POUR LES USAGES QUE VOUS VOULEZ EN FAIRE ET EGALEMENT EN CE QUI CONCERNE LA QUALITE ET LES PERFORMANCES DES LOGICIELS. CETTE RESTRICTION S\u2019APPLIQUE NONOBSTANT L\u2019INADAPTABILITE DE TOUTE SOLUTION APPORTEE. CERTAINES JURIDICTIONS NE PERMETTENT PAS L\u2019EXCLUSION OU LA RESTRICTION DES GARANTIES TACITES, CETTE EXONERATION DE GARANTIE PEUT DONC NE PAS VOUS ETRE APPLICABLE.<\/p>\n<p>5. LIMITATION DE RESPONSABILITE. SAUF OBLIGATION LEGALE, E4TECH SOFTWARE SA ET SES DISTRIBUTEURS, ADMINISTRATEURS, DONNEURS DE LICENCE, COLLABORATEURS ET AGENTS (COLLECTIVEMENT, LE \u00ab GROUPE E4TECH SOFTWARE SA\u00bb) NE SONT PAS RESPONSABLES DES EVENTUELS DOMMAGES INDIRECTS, PARTICULIERS, ACCESSOIRES, CONSECUTIFS OU EXEMPLAIRES DECOULANT DU PRESENT CONTRAT OU S\u2019Y ATTACHANT DE QUELQUE MANIERE QUE CE SOIT OU LIES A L\u2019UTILISATION DU LOGICIEL OU A L\u2019INCAPACITE DE L\u2019UTILISER, Y COMPRIS MAIS SANS S\u2019Y LIMITER, LES DOMMAGES LIES A LA DEFECTION DE CLIENTS, L\u2019INTERRUPTION DE TRAVAUX, LA PERTE DE REVENUS, LA PERTE DE DONNEES ET LA DEFAILLANCE OU LE MAUVAIS FONCTIONNEMENT D\u2019ORDINATEURS, MEME EN CAS DE MISE EN GARDE CONTRE LA POSSIBILITE DE TELS DOMMAGES ET QUELLE QUE SOIT LA THEORIE (CONTRAT, QUASI-DELIT OU AUTRE) SUR LAQUELLE SE BASERAIT UNE EVENTUELLE DEMANDE. LA RESPONSABILITE COLLECTIVE DU GROUPE E4TECH SOFTWARE SA DANS LE CADRE DE CE CONTRAT NE PEUT DEPASSER LES DROITS (EVENTUELLEMENT) VERSES POUR LA OU LES LICENCES. CERTAINES JURIDICTIONS NE PERMETTENT PAS L\u2019EXCLUSION OU LA RESTRICTION DES DOMMAGES ACCESSOIRES, CONSECUTIFS OU PARTICULIERS, CETTE EXCLUSION ET CETTE RESTRICTION PEUVENT DONC NE PAS VOUS ETRE APPLICABLES.<\/p>\n<p>6. DIVERS. (a) Le pr\u00e9sent contrat constitue l\u2019int\u00e9gralit\u00e9 de l\u2019accord intervenu entre E4tech Software SA et vous, concernant l\u2019objet qui y est trait\u00e9, et il ne peut \u00eatre modifi\u00e9 que par amendement \u00e9crit etsign\u00e9 par un responsable habilit\u00e9 de E4tech Software SA. (b) Sauf disposition contraire \u00e9ventuelle du droit applicable, le pr\u00e9sent contrat est r\u00e9gi par les lois de l\u2019\u00e9tat du Canton de Vaud (Suisse), \u00e0 l\u2019exclusion de ses dispositions relatives au conflit des lois. (c) Ce contrat n\u2019est pas r\u00e9gi par la convention des Nations unies sur les contrats de vente internationale de marchandises. (d) Si quelque partie que ce soit de ce contrat est consid\u00e9r\u00e9e invalide ou inapplicable, cette partie doit \u00eatre interpr\u00e9t\u00e9e de sorte \u00e0 refl\u00e9ter l\u2019intention initiale des parties, et les portions restantes resteront pleinement en vigueur. (e) La renonciation par l\u2019une ou l\u2019autre des parties \u00e0 une modalit\u00e9 ou condition quelconque de ce contrat ou toute d\u00e9nonciation dudit contrat, dans quelque circonstance que ce soit, ne constitue pas une renonciation \u00e0 une telle modalit\u00e9 ou condition, ni une quelconque rupture ult\u00e9rieure du contrat. (f) Sauf disposition l\u00e9gale contraire, la langue r\u00e9gissant le pr\u00e9sent contrat est le fran\u00e7ais. (g) Vous pouvez c\u00e9der les droits qui vous sont octroy\u00e9s en vertu de ce contrat \u00e0 toute partie qui accepte ses modalit\u00e9s et convient d\u2019\u00eatre li\u00e9e par elles. E4tech Software SA peut c\u00e9der les droits qui lui sont octroy\u00e9s en vertu du pr\u00e9sent contrat sans condition.
